Sleep Toolbox app terms of use
Effective date: October 6, 2026
These Terms of Use cover the Sleep Toolbox app for iPhone, iPad, and Android. They are an agreement between you and Everyday Insight LLC, a California limited liability company. Here, “we” and “us” mean Everyday Insight LLC. The mysleeptoolbox.com website has its own terms at mysleeptoolbox.com/terms.
1. Agreeing to these terms
By accepting these terms in the app, or by using the app, you agree to these terms and to the app’s Privacy Policy, which is part of them. If you don’t agree, please don’t use the app.
2. What Sleep Toolbox is
Sleep Toolbox offers self-help tools drawn from cognitive behavioral therapy for insomnia, along with educational articles. Each morning, you fill in a short sleep diary, and the app works out plain numbers from it, like your time in bed and how long you slept. You can set up a sleep window built from your diary, follow the stimulus control rules, use worry time, a wind-down routine, and relaxation exercises in the evening, and take an optional sleep check-in.
It is a structured way to reflect, for education and personal use.
3. Not therapy, medical care, or crisis support
The app does not provide therapy, counseling, medical care, assessment, diagnosis, treatment, crisis services, or emergency support, and it is not a substitute for care from a qualified professional. It is not a medical device.
Using the app or contacting us does not create a therapist and client relationship, or any other professional or fiduciary relationship, with Everyday Insight LLC or any person. Nothing in the app is advice directed at you or your situation.
If you work with a therapist, psychiatrist, physician, or other clinician, we encourage you to share what you do in the app with them and to follow their guidance where it differs from anything in the app.
4. Using the app at your own risk
Paying close attention to your sleep can make worry about it feel stronger for a while. A sleep window limits your time in bed, which can make you very sleepy during the day, especially in the first weeks, and sleepiness makes accidents more likely.
Don’t drive or do anything risky when you feel drowsy. If your sleep or your mood keeps getting worse, or sleepiness makes you feel unsafe, stop using the sleep window and talk with a health care provider.
You alone decide what to write, what to do, and when to stop. You use the app at your own risk. To the fullest extent the law allows, Everyday Insight LLC is not responsible for any discomfort, distress, injury, loss, or other harm arising from your use of the app or from anything you do or don’t do because of it. If a clinician has advised you against something, don’t use the app to do it.
5. About Sleep Toolbox
Sleep Toolbox doesn’t diagnose or treat insomnia, sleep apnea, or any other sleep disorder, and it isn’t a substitute for a sleep evaluation. The numbers it shows, its patterns, and your check-in score are simple summaries of what you entered, not a diagnosis. The app never tells you whether you have a sleep disorder or whether you’ve improved.
Before you set up a sleep window, the app shows a safety notice, and you can start a window only after accepting it. Please follow it. Talk with a health care provider before using the sleep window if you have bipolar disorder, a seizure disorder, sleep apnea, sleepwalking or other unusual behavior during sleep, a history of falls, or another health problem, if you’re pregnant, or if you drive or use machinery for work. You can choose sleep compression instead, which shrinks your time in bed more gradually, or skip the window and keep using the rest of the app. The window isn’t built for rotating shifts.
The app never suggests a window shorter than 5 hours and 30 minutes, and it never changes your window on its own. Each week’s suggestion is yours to accept or decline.
Sleep that the app reads from Apple Health or Health Connect is an estimate made by your watch or phone. It can differ from how the night felt, so the app shows it beside your diary and never uses it in place of your answers.
Sleep Toolbox is made for adults. Insomnia in children and teens is handled differently, so anyone under 18 should use the sleep window only with a clinician’s guidance.
Get checked by a doctor if you snore loudly, gasp, or stop breathing for moments in your sleep. The same goes for urges to move your legs at night, acting out your dreams, falling asleep while driving or in the middle of things, trouble sleeping that has lasted three months or more, and sleep that changed with a new medication or health problem. Never change a prescription without talking with the person who prescribed it.
6. If you are in crisis
The app is not a crisis service, and nobody monitors what you write in it.
In an emergency, call 911 or your local emergency number. If you are in crisis in the United States, call or text 988. For Spanish, call 988 and press 2, or text AYUDA to 988. In Mexico, call Línea de la Vida at 800 911 2000.
7. Age
Sleep Toolbox is not intended for children under 13. If you are under 18, use it only with the involvement and permission of a parent or legal guardian.
8. Cost
The app is free. It has no subscriptions, in-app purchases, paid features, or ads, and no account is needed.
9. Your license to use the app
We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own reflection and, if you are a clinician or educator, with the people you work with. We may suspend or end this license if the app is used in breach of these terms.
10. If you are a clinician or educator
You are welcome to use the app in your work. Doing so is your professional decision, and these terms don’t change what you already owe your clients or students.
You remain responsible for your own judgment, for whether this exercise suits a particular person, for your professional, ethical, and licensing obligations, and for any consent a client should give. We have no relationship with your clients and no view into how the app is used.
The app is not a HIPAA-covered service. We are not a business associate, and we won’t enter into a business associate agreement. Don’t use the app to collect, send, or store protected health information for your practice.
11. What you create stays yours
What you write in the app belongs to you. We claim no ownership of it and no license to it. We don’t receive it either, because the app has no accounts and no server of ours. The Privacy Policy explains how the app stores your data.
Because your data is on your device and in your own accounts, keeping it safe is up to you. Deleting the app, losing your device, or removing the synced copy can erase it, and we can’t recover it for you.
12. Methods, sources, and credit
Cognitive behavioral therapy for insomnia, the sleep diary, stimulus control, sleep restriction, sleep compression, worry time, and relaxation are established methods described in the research the app cites. The diary’s questions cover the items sleep diaries commonly ask about, in our own wording. The prompts, articles, worked examples, and layout were written for the app.
The sleep check-in uses the Sleep Condition Indicator, which is © Sleepio Limited and is used under a Creative Commons Attribution-NonCommercial 4.0 International license. It was published by C. A. Espie, S. D. Kyle, P. Hames, M. Gardani, L. Fleming, and J. Cape as “The Sleep Condition Indicator: A clinical screening tool to evaluate insomnia disorder,” BMJ Open, volume 4, e004183, 2014. In the app, the questions appear on one page with the ranges written out in words, the note on the second question sits below it, and the score is shown on a scale of 0 to 10. The Spanish translation is our own and hasn’t been validated.

13. Our content and using our materials
Everyday Insight LLC or its licensors own the copyright and other rights in the app, its design, code, writing, and examples, and in the layout of the documents it creates. What you write in those documents stays yours. You may use the app and what it exports for yourself and, if you are a clinician or educator, with the people you work with.
You may not sell the app or its materials, charge for access to them, include them in a product you sell, or remove the Everyday Insight name or source credits from copies you share. Any other use needs our written permission, which you can ask for at hello@mysleeptoolbox.com.
14. Acceptable use
Don’t copy, resell, or redistribute the app, reverse engineer it except where the law allows, use it to break the law or harm anyone, or try to interfere with it.
15. Sync, app stores, and other services
If you turn on sync, your data is stored in your own iCloud account or Google Drive. Those services are run by Apple and Google, not by us, and their terms and privacy policies apply. The same is true of Apple Health and Health Connect if you use them with the app. The app is distributed through the App Store and Google Play, whose own terms also apply. Links in the app lead to websites we don’t control, and linking to them isn’t an endorsement.
16. Availability and changes
We may change, suspend, or stop any part of the app, including sync and reminders, at any time.
17. Disclaimer of warranties
The app is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability. We don’t promise that the app will be uninterrupted or error-free, or that using it will improve any health or wellness outcome. Some jurisdictions don’t allow certain warranties to be excluded, so some of this may not apply to you.
18. Limitation of liability
To the fullest extent the law allows, Everyday Insight LLC and its owners, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the app.
Because the app is free, and to the fullest extent the law allows, our total liability for any claim relating to the app or these terms will not exceed one hundred US dollars. Nothing in these terms limits liability that the law does not allow to be limited, including liability for gross negligence, fraud, or willful misconduct.
19. Indemnification
You agree to indemnify and hold harmless Everyday Insight LLC and its owners, employees, and licensors from claims, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising from your misuse of the app or your violation of these terms or the law. If you use the app with clients, this includes claims brought by them. It doesn’t apply to harm caused by our own misconduct.
20. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules, except where the consumer protection laws of your home jurisdiction provide otherwise.
Before filing a claim, please contact us at hello@mysleeptoolbox.com and give us at least 30 days to try to resolve the dispute informally. If we can’t, any dispute arising out of or relating to these terms or the app will be brought only in the state or federal courts located in California, and both you and we consent to their jurisdiction. Either of us may still bring a qualifying claim in small claims court or seek an injunction to protect intellectual property rights.
21. Changes to these terms
We may update these terms. When we do, we’ll post the new version at mysleeptoolbox.com/app/terms with a new effective date, and the app will ask you to accept it the next time you open it.
22. Language
These terms are available in English and Spanish. If the two versions differ, the English version controls.
23. General
If any part of these terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision, that isn’t a waiver of it. You may not transfer your rights under these terms. We may transfer ours to a successor, for example if Everyday Insight LLC is sold or reorganized. The sections on not providing care, use at your own risk, what you create, our content, warranties, liability, indemnification, and governing law continue after you stop using the app. These terms and the Privacy Policy are the entire agreement between you and us about the app.
24. Additional terms for the App Store
These apply to the app on iPhone and iPad.
- These terms are between you and Everyday Insight LLC only, not with Apple. We alone are responsible for the app and its content.
- Your license is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, including use by others in your Family Sharing group where those rules allow it.
- We alone are responsible for any maintenance and support for the app. Apple has no obligation to provide any.
- We alone are responsible for any product warranties. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, which for this free app is zero. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
- We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country, and that you are not on any United States government list of prohibited or restricted parties.
- When you use the app, you must follow any third-party terms that apply to you, such as your wireless carrier’s data agreement.
- Questions, complaints, or claims about the app can be sent to Everyday Insight LLC at hello@mysleeptoolbox.com.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce them against you.
25. Additional terms for Google Play
If you got the app from Google Play, the Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the app or its content.
